Introduction

ElMenut offers you an online shopping service that allows you to purchase some of the products available in our physical stores directly from our website. In addition, you can enjoy exclusive promotions, gifts, and offers. Below, we invite you to review the general terms of sale that govern the purchase of ElMenut products through the website www.elmenut.com (the “Website”) hereinafter. It is the user’s responsibility to know the General Terms of Sale in force at the beginning of the Purchase process. ElMenut may modify these General Terms of Sale, as well as the prices of its products, at any time. Such modifications will not in any case affect purchases made prior to their approval, which will be governed by the General Terms in force at the time of those purchases.

Please carefully review the product information to learn about its specific conditions, as these General Terms may be supplemented or modified by specific clauses or conditions applicable to certain products, especially regarding the exclusion of withdrawal rights, exchanges, or refunds.

2. Activity

At ElMenut, for more than 25 years, we have been dedicated to the sale of furniture and interior design projects. We specialize in optimizing fully customized spaces, which has allowed us to offer various types of services tailored to the needs of each client.

2.1 Personalized projects:

We optimize functional spaces with custom-made furniture, mainly for the youth, children, and baby sectors. Through our online store and our physical stores in Spain, we offer all the necessary advice for the customer to create their ideal room. Our interior designers develop a 3D project proposal with the actual measurements of the space, so that the customer can visualize the final result.

2.2 Online store:

The items offered on the website are a selection of products from the collection we have developed, thanks to our extensive experience in the sector, which enables us to meet any type of need in a simple and efficient way. This collection meets the same quality and warranty requirements as the products sold in our stores and personalized projects. The collection is mass-produced with standard, non-modifiable measurements once the customer selects the product. It is available in four qualities: economic, medium, premium, and lacquer. With this purchasing option, our aim is to offer the best quality products within any budget.

Our furniture collection includes beautiful colors, finishes, and textiles previously selected to suit all types of customers—children, youth, or adults—as well as any decorative style found in the home. We offer several customization options regarding colors, measurements, and accessories, allowing us to adapt to any home style.

2.2 Online store:

The items offered on the website are a selection of products from the collection we have developed, thanks to our extensive experience in the sector, which enables us to meet any type of need in a simple and efficient way. This collection meets the same quality and warranty requirements as the products sold in our stores and personalized projects. 2.3 Service availability:

When placing an order on the website, the customer confirms that they are over 18 years old. The products offered are distributed throughout Spanish territory, including the Balearic Islands, Canary Islands, and Melilla. We also deliver to the rest of Europe (please consult transportation and assembly services in advance).

2.4 Product information:

The presentation of the products is based on a classification criterion through catalogs that group categories, customization options, and models, or through home environments arranged by utility.

Each product is accompanied by the following information:

  • Product name
  • Product image(s)
  • Product description
  • Available measurements, colors, and finishes*
  • Description of qualities
  • Retail Price (in the corresponding currency: €)
  • Approximate delivery time information
  • Personalization options (if applicable)
  • Wall type required for installation (if applicable)

ElMenut has made an effort to display the colors, finishes, and shapes of the products as accurately as possible. However, the images and 3D drawings attached to this order are merely illustrative and may vary in reality, depending on the product or material chosen. For this reason, ElMenut cannot guarantee that the shapes, colors, and finishes shown in this order match reality exactly.

Special offers, promotions, or discounts will remain valid until the indicated date or while stocks last.

Likewise, ElMenut makes every necessary effort to ensure that the information contained on the website is complete, truthful, and correct. If any errors are found,

ElMenut will proceed to correct them.

3. Purchase procedure

At ElMenut we offer two different purchasing procedures, depending on whether it is a personalized custom-made project or an online store purchase.

3.1 Personalized projects:

  • a) Browsing our website allows the customer to save their favorites.
  • b) The customer may choose between the buttons Request a 3D Project, Personalized Price, or Request Price.
  • c) To begin the personalized project process, the customer must complete the request form indicating their needs, for example: 'The room is for 2 children and we do not need a wardrobe'. This helps us maximize the use of the available space, taking into account both the customer's needs and their budget. The customer can also adjust finishes, color combinations, and handles until achieving the desired product.

  • e) The customer may attach previously saved favorites, as well as a drawing or floor plan with the space measurements—this last item is essential.

For foldable furniture requiring fastening to walls, the customer must indicate the type of construction material of the wall or supporting surface to determine the viability and safety of installation. The customer is responsible if the real conditions of the wall do not match the information provided. The customer assumes responsibility for the resistance of the walls where such furniture is to be installed, especially if made of plasterboard or Panel System.
Slight variations in tone and color may occur due to the type of device from which the products are viewed (computer, tablet, or mobile phone).

3.2 Online Store:

  • a) Items to be purchased must be selected and added to the shopping cart by clicking the corresponding icon.
  • b) The shopping cart contains the reference of the selected item, its name, quantity, and price in the corresponding currency (VAT, assembly, and shipping included, with fees varying depending on the selected province; customs taxes for Ceuta, Melilla, the Canary Islands, the Balearic Islands, or non-EU countries are paid by the customer).
  • c) To complete the purchase, the customer's personal information will be required. This will be added to our database to process the order and facilitate future purchases through the website. Personal data is processed according to our Privacy Policy. The customer may access their personal data and order information at any time. ElMenut reminds customers that personal information must be provided accurately to avoid confusion or incidents during delivery. Additionally, if requested by the customer, personalized commercial communications may be sent by email and/or SMS.
  • d) Before placing the order, a summary will be shown to the customer listing the product(s) added to the shopping cart, the total price including shipping, installation, and VAT (customs duties for Ceuta, Melilla, the Canary Islands, the Balearic Islands, or non-EU countries are paid by the customer), with each item broken down, along with the delivery details. The customer must confirm by clicking the button 'Confirm Payment'. If an error is detected before confirming payment, the customer may modify any detail by clicking 'Edit' or 'Delete'. If an error is detected after completing payment, please contact Customer Service (pedidosonline@elmenut.com). Once the order is placed, the website will show the order number so the customer may track it from their account at any time. An automatic email will also be sent confirming receipt of the order, including a description and the customer’s personal data. If this message is not received, it may be due to a temporary communication issue or an incorrect email address. ElMenut recommends checking the spam folder or contacting Customer Service.
  • f) Receipt of the confirmation email does not constitute acceptance of the order by ElMenut. The customer’s order is an offer to purchase the product(s). All orders are subject to acceptance by ElMenut, which is not obligated to accept any order. By clicking 'Confirm Payment', the customer acknowledges their obligation to pay once the order is accepted. Acceptance will be communicated via an additional email confirming the order has been shipped or is ready for pickup (“Confirmation”). Unless otherwise stated in point 3.3, the contract between the customer and ElMenut is formalized when ElMenut sends the Confirmation. The Contract applies only to the product(s) listed in the Confirmation. ElMenut is not obligated to supply any product not confirmed.

3.3 Product availability

All orders are subject to product availability. If, at the time the order is issued, ElMenut detects a lack of stock of any of the products included, ElMenut will attempt to locate the product through other available means. If it is not possible, the delivery date will be modified until the order can be completed.

3.4 Right to refuse an order

ElMenut may cancel any confirmed order or refuse an order for the following reasons:

  • 1. In case of technical and/or typographical errors in the prices or product details on the website at the time of the order.
  • 2. Due to lack of availability as described in point 3.3.
  • 3. When security systems indicate that the order may be fraudulent.
  • 4. When there are indications that the customer is a minor.
  • 5. When ElMenut has been unable to deliver the order to the address provided.
  • 6. In case of a cyber attack, virus, or any event beyond ElMenut's reasonable control (force majeure).

In such cases, ElMenut will fully refund any amounts paid as described in the following section.

4. Payment method:

At ElMenut we offer two different purchasing procedures, depending on whether it is a personalized custom-made project or an online store purchase.

4.1 Payment and currency

4.2 Value Added Tax

All product prices listed on this website include VAT at the applicable rate. In deliveries to the Balearic Islands, Canary Islands, Ceuta, and Melilla, the corresponding taxes and duties will apply according to the regulations in each territory. Likewise, any additional taxes such as customs or import duties applicable at the moment of order receipt are not included and must be paid by the customer. For international purchases, the EXW (Ex-works) incoterm will apply.

4.3 Invoicing

The customer expressly consents to receiving the invoice in electronic format. If the customer wishes to receive a paper invoice, they may request it at any time by contacting our Administration department (administracion@elmenut.com).

4.4 Payment methods

ElMenut only accepts payments made via credit or debit card, BBVA financing, or bank transfer.

  • a) Payment by credit or debit card ElMenut accepts Visa and MasterCard payments for purchases made through the website. If the customer chooses to pay by credit or debit card, the charge will be made online, in real time, through the secure payment gateway of the corresponding financial institution once the data has been verified.
  • b) Payment by bank transfer All costs associated with making a bank transfer must be paid by the customer. Customers will receive the bank account details via email once the order is confirmed. As a reference, the customer must indicate their order number and full name. The customer has three (3) business days from the date of the order to complete the payment. The order will not be considered accepted until the transfer has been verified. If ElMenut has not received the payment after this period, the order will be cancelled.
  • c) Personalized projects: Send proof of payment along with the signed copy of the order (after verifying that everything is correct) to administracion@elmenut.com. From that moment, the order will enter the production phase.

If you wish to make a payment in store, please note that cash payments over €2,499 per invoice are not allowed, according to Law 7/2012 of 29/10/2012. Cash payments are not accepted for online purchases.

4.5 Payment security

To ensure maximum security in the payment system, ElMenut uses secure payment systems from leading financial institutions in e-commerce. Payment data is transmitted securely and encrypted (SSL) directly to the corresponding financial institution. For Visa and MasterCard, ElMenut only accepts CES (Secure E-Commerce) transactions, including the international 3D Secure protocol, identified by the Verified by Visa and MasterCard SecureCode logos. When paying through the secure gateway, the system automatically verifies that the card is activated for Secure E-Commerce. It then connects with the issuing bank, which requests authorization via a personal authentication code. The transaction will only be completed if the issuing bank confirms this code; otherwise, it will be rejected. We also use the SSL security certificate from Let’s Encrypt. As an additional anti-fraud measure, ElMenut reserves the right to verify the customer’s personal data and take any actions deemed appropriate (including order cancellation) to ensure that the merchandise is delivered in accordance with the order details.

5. Shipping:

The shipping method will vary depending on the type of purchase.

5.1 Personalized projects:

Shipping and assembly are included. Our furniture assembly specialists will contact the customer beforehand to schedule a delivery date, bring the furniture home, unpack it, and leave it fully assembled and installed. The expected delivery time ranges from 30 to 80 days (depending on the collection and level of customization) from the date the order is formalized, excluding holidays, August, Easter, and Christmas. Any incident occurring during this period will interrupt the time count. The customer must ensure adequate access for the delivery and installation of the furniture; otherwise, they will assume the cost of any external resources required (cranes, lifting platforms, etc.). 5.2 Accessories and Decoration:

The risk of the products is transferred to the customer from the moment of delivery. Products purchased through the website will be shipped via a courier company and delivered within the timeframe indicated on the website according to the chosen shipping method, and in any case within a maximum of thirty (30) calendar days from the order Confirmation date. If an order contains items with different delivery times, it will be shipped according to the longest timeframe. Depending on the items purchased, a single order may be delivered in multiple shipments. You may choose whether to receive all items in one shipment or in several. Return costs are not included for any product category. With this service, delivery is made to the entrance of your building or home; the courier is not required to deliver inside your residence. www.elmenut.com coordinates communication between the transport company and the customer by providing a “tracking number” via email, linked in real time to the courier system, showing the status and location of the shipment at all times. Shipping cost depends on the selected method and the total price of the products purchased.

The exact shipping cost will be calculated when each item is added to the shopping bag and will be detailed—and discounted—on the summary page before the customer confirms the order by clicking 'Confirm Payment' and before entering payment details.

5.3 Online store furniture:

As with personalized projects, shipping and assembly are included. Our assembly specialists will contact the customer in advance to schedule delivery, bring the furniture to their home, unpack it, and leave it fully assembled. The expected delivery time is between 30 and 80 days (depending on the collection and customization) from the order date, excluding holidays, August, Easter, and Christmas. Any incident within this period will interrupt the delivery timeline. The customer must ensure proper access for delivery; otherwise, they will bear the cost of any external equipment needed (cranes, lifting platforms, etc.). To avoid delivery issues (incorrect addresses, absence at home, etc.), the form must be completed correctly. Orders cannot be shipped to military bases or PO boxes. Shipping costs may be modified at any time without prior notice; changes apply from the moment they appear in the Terms of Sale. The shipping cost in effect at the order time will apply. If merchandise is returned to our warehouse due to repeated failed delivery attempts or reasons beyond ElMenut’s control, we reserve the right to charge shipping fees again or cancel the order, deducting transportation costs. When the customer requests order modifications: For address changes that involve a change of region or province, and therefore of transport carrier, additional fees will apply, subject to prior communication and acceptance. If access to your home is difficult, please notify the carrier beforehand (no elevator, narrow stairs, etc.). If the item is unavailable, we will inform you and commit to resolving the issue as soon as possible. By law, if the contract cannot be fulfilled because the product or service is unavailable, the consumer must be informed. Products listed under “Furniture” cannot be sold without the “assembly included” feature to ensure the quality of service and furniture.

6. Warranty:

ElMenut complies with the legal warranties required by current regulations valid at the time of the defect. All furniture has a 24-month warranty covering manufacturing defects. This warranty includes shipping, materials, and labor. However, as stated in the consumer goods warranty law, characteristics inherent to the product or damage caused by misuse are excluded. The warranty does not cover deficiencies caused by negligence, impacts, improper use or handling, incorrect installation not performed by authorized personnel (when applicable), or materials subject to wear from normal use.

6.1 Invalid warranty:

a) If any data on the warranty or original purchase invoice is modified, altered, or replaced.
b) When the item has been handled or repaired by personnel not authorized by ElMenut.
To use the warranty, it is essential to present proof of purchase or invoice by sending an email to postventa@elmenut.com

7. Exchange and/or return policy:

In accordance with the General Law for the Protection of Consumers and Users, the customer has the right to withdraw from their order within 14 calendar days from receipt, without having to provide a reason and without incurring expenses other than those provided by law. To exercise the right of withdrawal, the customer must send an email to postventa@elmenut.com stating their decision to cancel the order. This communication must always be sent within the stated timeframe. Items subject to withdrawal must be returned in perfect condition, in their original packaging, and with all accessories. The refund will be made within 14 days from receipt of the withdrawal request and may be withheld by ElMenut until the goods are received and verified to be in perfect condition. Return costs are borne by the customer. No spontaneous return will be accepted without prior agreement with ElMenut.

7.1 Personalized projects:

Customized or made-to-measure furniture is not eligible for the right of withdrawal. No exchanges or returns will be accepted for products manufactured with special measurements or personalized according to customer specifications (choice of color, materials, measurements, finishes, fabrics, leather, upholstery), except those with manufacturing defects or incorrect delivery. Once the contract for a personalized project is completed and signed, it cannot be canceled.

7.2 Decoration and accessories:

For hygiene reasons, items intended for personal use or rest—such as bed bases, bed frames, mattresses, blankets, cushions, rugs, pillows, sheets, etc.—cannot be exchanged or returned once the protective plastic seal has been removed. If the customer wishes to cancel their order before receiving it, they must contact pedidosonline@elmenut.com. Cancellation will only be accepted in the following cases:
a) When the order has not yet been shipped, in which case a full refund of the order or the specific items will be issued.
Return costs will only be covered by ElMenut in cases of incorrect shipment or manufacturing defects.

7.3 Online store furniture:

The right of withdrawal does not apply to products in this category because they are manufactured specifically for the customer.
If the merchandise arrives damaged due to transport issues, with visible impacts or breakage, the customer must send an email to postventa@elmenut.com with the order number and photos clearly showing the damage within 24 business hours of receipt. Failure to meet this deadline gives ElMenut the right to refuse replacement.
Shipping costs will only be covered by ElMenut in cases of incorrect shipment or manufacturing defects.
Cancellation is only possible when the order has not yet entered production, in which case a full refund will be issued for the order or for the canceled items.

8. Customer obligations:

The customer commits to providing accurate information in the user registration or purchase forms and to keeping it updated at all times. When completing the registration or purchase form, the customer must accept these General Terms of Sale and our current Privacy Policy. If the customer provides an incorrect delivery address or one where delivery cannot be completed during normal delivery hours, ElMenut shall not be responsible for delays or inability to deliver the order.

9. Security and confidentiality:

ElMenut guarantees the security and confidentiality of all communications with customers, as well as personal, address, payment, and any other data provided by customers, in accordance with Organic Law 15/1999 of December 13 on Personal Data Protection. All data provided to www.kenayhome.com or its employees will be stored in an automated file created and maintained under the responsibility of ElMenut, in compliance with Organic Law 15/1999 of December 13. 10. Applicable legislation and jurisdiction:

Purchases made through www.elmenut.com are subject to Spanish legislation. In the event of any conflict or discrepancy regarding the interpretation or application of these contractual conditions, the competent courts will be those established by applicable legal regulations for matters of jurisdiction. In the case of consumers, this typically corresponds to the place where the obligation is fulfilled or the customer’s residence. If the customer resides outside Spain, both parties submit—expressly waiving any other jurisdiction—to the Courts and Tribunals of Valencia (Spain).
